What he does and what he says ____ (be) not agree， 我认为用is 比较合适，因为主语是”what he does" 和“what he says"是不可数，后面肯定跟的是单数，而且用的是一般现在时，后面跟一般现在时比较妥当，选来选去非”is“莫属， 你认为呢？
